PHOTOGRAPHIC CONTRACT/ MODEL AGREEMENT

PORTRAIT SESSION: Client is guaranteed up to 30 minutes of shooting time.

CANCELLATION/POSTPONEMENT: Sessions are non-refundable, but deposits (if given) are transferable if a date change is necessary (48 hours notice of postponements or cancellations is appreciated).

WEATHER: If sessions are canceled due to weather, Photographer and Client will reschedule at the earliest date possible, with no additional charge.

COOPERATION/NO SHOWS: Client will arrive 10 minutes early due to short shooting window. Photographer is not responsible if Client and/or key individuals fail to appear or cooperate during portrait sessions.  No refund will be given if client has prepaid and is a no-show.  

COPYRIGHT: All images are copyrighted and remain the property of Susan McCallum with Infinity Photography. It is illegal to copy, scan, reproduce, or post online in forums elsewhere without written permission of Infinity Photography.  Client is not allowed to alter or distort images in any way.  

CLIENT’S USAGE: Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions. Client has pull printing rights.  

FAILURE TO PERFORM: Due to the limited and subjected nature of the event, Infinity Photography cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, by the venue restrictions.  The photographer is not responsible for lost photo opportunities due to cameras or flashes, the lateness of the client or affiliated parties.  The photographer is not responsible for the lack of coverage due to weather conditions, schedule complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decor at venue.  It is acknowledged that any lists submitted to Infinity Photography will be used for organizational purposes only and in no way represents photography that will actually be produced.  Infinity Photography will use due diligence to fulfill all requests, but can make no guarantees all images will be delivered.  Clients are responsible for all location fees and permits (unless previously arranged with Infinity Photography).  

DAMAGED EQUIPMENT: If any photographic equipment or props owned by Infinity Photography is damaged or destroyed by client or affiliated parties, while working at contracted session/ event, the client will absorb any and all necessary costs to repair or replace the equipment, or insurance deductible, whichever is less.  

FORCE MAJEURE: If Infinity Photography, or its assigns, cannot perform this agreement due to a fire, casualty, strike, or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism, or other causes beyond the control of the parties, or due to the photographers illness, then Infinity photography shall return any moneys paid by the client, less expenses, but shall have no further liability with respect to the agreement.  This limitation of liability shall also apply in the event that photographic material are damaged in processing, lost through camera malfunction, compact flash card malfunction, lost in mail, or otherwise lost or damaged without the fault on the part of Infinity Photography.  

EXCLUSIVE PHOTOGRPAHER: Infinity Photography shall be the exclusive photographer retained by th client for the purpose of photographing event, unless another arrangement has been agreed on.  Family and friends of client and other wedding vendors shall not interfere with the photographer's duties, and to preserve creative property of photographer.  Guests will basked to refrain from taking flash photographs at certain intervals of event to ensure proper exposure. 

GARMENTS: Infinity Photography cannot be held responsible for damage to Garments during environmental events.  Client is responsible to arrange personal assistance for garments, if required.  

TOUCH-UPS: Although diligent efforts are made to avoid environmental problems and effects, all client-requested photographic touch-ups or alteration not included in the purchased product will only be performed at the client's expense.  Such retouching may include but is not limited to correction of hair/make up, environmental effects, clothings, reflections in glass, open or closed eyes, removal/ insertion of family members, fixtures, etc.

CREATIVE LISCENCE: Images are edited the photographer's discretion, and delivered prints may not include all images captured.  The photographer reserves the creative right to edit and release one those deemed credible as professional in quality and within the photographer's artistic standards.
